These Terms and Conditions ("Terms") govern your access to and use of Alertify (PTY Ltd) ("the App"), provided by Alertify (PTY Ltd), located at 125 Bram Fisher Road, North Beach, Durban, South Africa.
By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the App.
**1. Acceptance of Terms**
1.1. You must be at least 18 years old to use the App.
1.2. By using the App, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into these Terms.
**2. Use of the App**
2.1. You agree to use the App only for lawful purposes and in accordance with these Terms.
2.2. You may not use the App in any way that could damage, disable, overburden, or impair the App or interfere with any other party's use and enjoyment of the App.
**3. User Accounts**
3.1. To use certain features of the App, you may be required to create a user account. You are responsible for maintaining the confidentiality of your account and password and for restricting access to your account.
3.2. You agree to accept responsibility for all activities that occur under your account.
3.3. You agree to provide accurate and complete information when creating your account and to update your information promptly if it changes.
**4. Privacy Policy**
4.1. Your privacy is important to us. We do not collect, store, or share any personal data for users of any of our applications. Our end user application may be installed and used without personal data being required.
**5. Intellectual Property**
5.1. All content, trademarks, logos, and other intellectual property rights related to the App are the property of Alertify (PTY Ltd) or its licensors.
5.2. You may not use, modify, reproduce, distribute, or create derivative works based upon any part of the App without our prior written consent.
**6. Limitation of Liability**
6.1. To the fullest extent permitted by law, Alertify (PTY Ltd) shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (a) your access to, use of, inability to access, or inability to use the App; (b) any third-party conduct or content on the App; (c) any unauthorized access, use, or alteration of your transmissions or content.
**7. Indemnification**
7.1. You agree to defend, indemnify, and hold harmless Alertify (PTY Ltd) and its affiliates, officers, directors, employees, and agents from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including but not limited to attorney's fees) arising from: (a) your use of and access to the App; (b) your violation of any term of these Terms; (c) your violation of any third-party right, including without limitation any copyright, property, or privacy right.
**8. Governing Law and Jurisdiction**
8.1. These Terms shall be governed by and construed in accordance with the laws of South Africa.
8.2. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of South Africa.
**9. Changes to Terms**
9.1. Alertify (PTY Ltd) reserves the right to modify or revise these Terms at any time without notice. By continuing to use the App after any changes to these Terms, you agree to be bound by the revised Terms.
